Article 1 Definitions
The words used in these General Terms and Conditions, in singular or plural, starting with a capital letter, have the meaning as defined below in this article.
1.1 General Terms and Conditions: these General Terms and Conditions.
1.2 Order procedure: the procedure, which the Customer goes through interactively on the Website, to order Goods.
1.3 Customer: the other party of WLDC with whom WLDC enters into an agreement.
1.4 Agreement: agreement, of which the General Terms and Conditions form an integral part, regarding the purchase and delivery of Goods.
1.5 Parties: WLDC and the Customer jointly.
1.6 WLDC: the party using the General Terms and Conditions, also other party of the Customer.
1.7 Website: the website of WLDC, which can be found under the URL https://www.wldc.nl or https://welovedutchcheese.com.
1.8 Items: items that WLDC offers on its Website, which items the Customer can order.
Article 2 Applicability
2.1 The General Terms and Conditions apply to all Agreements, any (e-mail) newsletters, the Website, the Order procedure as well as contacts and/or (legal) acts between Parties, even if these (legal) acts do not lead to an Agreement.
2.2 Applicability of general terms and conditions of delivery or payment and/or other general or special terms and conditions of the Customer is expressly excluded.
Article 3 Realisation of the Agreement
3.1 The Goods offered on the Website with the corresponding prices shall be deemed to be a non-binding offer, which the Customer can accept by completing and completing the entire Order procedure.
3.2 WLDC does not guarantee that the offer referred to above is without errors and/or omissions. Printing and typesetting errors are therefore expressly reserved and can be grounds for not honouring the Agreement. If WLDC decides to do so, it will inform the Customer immediately.
3.3 If for any reason whatsoever, including the situation referred to in the last sentence of the previous paragraph, the Agreement has not been concluded, or has been dissolved, WLDC shall ensure that – if paid in advance by the Customer – the amounts paid, including the initial shipping costs, will be refunded to the Customer as soon as possible for WLDC. This refund is in any case within 30 (thirty) days.
Article 4 Prices and payment
4.1 Prices as mentioned on the Website are inclusive of VAT, as well as other government-imposed levies. The prices do not include shipping costs. These will be charged to the Customer during the Order procedure.
4.2 WLDC is entitled to adjust the prices at all times. The latter has no consequences for current Agreements, which will be executed at the agreed prices in the event of price increases.
4.3 The Customer can only pay the amounts due by means of electronic prepayment (e.g. via iDeal).
Article 5 Delivery term
5.1 WLDC aims to ship the order no later than the next working day. The delivery time depends on the delivery driver of the package and the destination.
5.2 WLDC will make every effort to deliver as soon as possible.
5.3 If and insofar as WLDC cannot deliver the ordered Goods to the Customer within 30 (thirty) days, the Customer has the right, after WLDC has informed the Customer that it is unable to execute the Agreement within the set period, to cancel the Agreement. Article 3.3 then applies accordingly.
Article 6 Right of Withdrawal
6.1 The Customer has the right to return the delivered Goods to WLDC within seven (7) working days after receipt, without giving reasons (i.e. without having to fill in the complaint form as referred to in Article 7.1):
- the Goods are in their original and unopened packaging and have not been used;
- the Goods are returned at the expense of the Customer; insufficiently stamped parcels will not be accepted by WLDC;
- the Customer is responsible for the way the parcel is sent and for the risk of the parcel – and this responsibility and risk are accepted by the Customer – until WLDC has received it.
6.2 The revocation is a resolutive condition whereby the Customer is entitled to a refund of what has already been paid. Article 3.3 applies by analogy in case of revocation.
Article 7 Complaints
7.1 If and insofar as, in the opinion of the Customer, the characteristics of the Goods do not comply with the Agreement, the Customer consults with WLDC after which the Customer is entitled to return the Goods to WLDC if necessary:
- Immediately after receipt, the Customer has inspected the delivered Goods and reported any defects to WLDC by e-mail within a reasonable period of time;
- the complaint form as shown behind these General Terms and Conditions has been completed in full and sent by e-mail;
- the Goods are returned at the expense of the Customer; insufficiently stamped parcels will not be accepted by WLDC;
- the Customer is responsible for the manner of sending and for the risk of the parcel – and this responsibility and risk are accepted by the Customer – until WLDC has received it.
7.2 If, after investigation by WLDC, it appears that the characteristics of the Goods comply with the Agreement, WLDC will consult with the Customer.
7.3 If, after WLDC’s examination, it appears that the characteristics of the Goods do not comply with the Agreement, the Customer is entitled to a replacement Good, provided it is still available, and a refund of the shipping costs as referred to under c of Article 7.1. If the replacement Good is not available, the Customer is entitled to a refund:
- to select a replacement Good of the value of the Good which turned out not to answer, if the selected Good is more expensive than the Good which turned out not to answer, the Customer shall pay the difference in price, if the selected Good is cheaper than the Good which turned out not to answer, the Customer shall be refunded the difference in price, whereby the last sentence of article 3.3 shall apply mutatis mutandis;
- restitution of the value of the Good which counts as (partial) dissolution of the Agreement to which the last sentence of article 3.3 applies mutatis mutandis.
7.4 Where the value of the Good is referred to in the preceding paragraph, this shall be understood to mean the price agreed in the Agreement.
7.5 During the period referred to in article 6.1, the Customer may also exercise the right granted in that article. However, in the case of a completed complaint form, the procedure as set out in this article is assumed.
Article 8 Processing of personal data
8.1 If and insofar as personal data of the Customer are processed, as described in our privacy statement, this processing shall only be valid for purposes of change:
- to be able to execute and enforce the Agreement;
- subject to the restriction of the following paragraph, to inform the Customer about (new) products and services of WLDC.
8.2 For sending commercial communications by electronic means to Customers (such as, but not limited to, e-mail newsletters) as referred to in the previous paragraph under b, the Customer’s explicit permission is requested during the Order procedure, and only if this permission has been granted by the Customer will WLDC send these communications.
8.3 The customer is at all times entitled to inspect his personal details free of charge and, if desired, to have these details adjusted by WLDC in case of inaccuracies.
Article 9 Applicable law, complaints and disputes
9.1 Dutch law shall apply to the Agreement and any further agreements arising therefrom.
9.2 If and as far as there is a complaint, the Customer contacts WLDC by e-mail. The e-mail address in question is stated at the top of these General Terms and Conditions. WLDC will respond to a complaint as referred to above within 30 (thirty) days at the latest.
9.3 The Customer may submit the dispute – if and insofar as the Parties jointly fail to resolve it – to a competent judge, including the interim injunction judge of the district court, adjudicating in summary proceedings.
Article 10 Other provisions
10.1 WLDC is at all times authorised to amend these General Terms and Conditions. Ongoing Agreements will be honoured under the old agreed conditions after the General Terms and Conditions have been amended.
10.2 If and insofar as login details have been provided by WLDC for the Order procedure, the Customer shall take care of these details himself. These details are strictly personal and may under no circumstances be transferred. The Customer is responsible for the consequences of careless handling of these data.
Article 11 Weight deviations and delivery
11.1 The cheese is freshly cut. This is handcrafted. Deviations in weight may occur. WLDC always tries to cut to the Customer’s advantage. The maximum bandwidth is 100 grams.
11.2 If the Client chooses a quarter or half cheese, it will be cut into handy pieces and packed airtight.
11.3 Whole cheeses will be delivered uncut as whole cheeses. Deviations in weight may occur.
